  • BREAKING: Supreme Court Denies Kim Davis' Request For Emergency Intervention

    The U.S. Supreme Court has just issued a response to the Kentucky clerk refusing to issue marriage licenses because same-sex couples marrying violates her religious beliefs.

    Kim Davis may be out of options.

    The U.S. Supreme Court has just said it will not place a stay on a ruling by U.S. District Court judge David Bunning that ordered Davis to issue licenses to married couples regardless of gender. On Friday, Davis's attorneys had asked the Court to intervene, saying forcing her to issue licenses to same-sex couples is a violation of her First Amendment rights.

    Davis' attorneys told Supreme Court Justice Elena Kagan that Davis is "a devout Christian" who "has faithfully and devotedly served the public in the Rowan County clerk’s office for nearly thirty years." They said she is seeking "asylum for her conscience," and should the Court refuse her request for an emergency stay of Judge Bunning's ruling, "then elected officials have no real religious freedom when they take public office." 

    Justice Kagan chose to send the request to the full court. Davis would have had to have at least three justices agree to hear her request, but it was denied, indicating there were not.

    Her attorneys, in a stunning choice of words, also claimed the Supreme Court's decision in Obergefell, "demands that she either fall in line (her conscience be damned) or leave office (her livelihood and job for three-decades in the clerk’s office be damned)."

    UPDATE I: 8:01 PM EDT -
    The AP reports Davis "will arrive at work Tuesday morning to face her moment of truth," and "will have to choose whether to issue marriage licenses, defying her Christian conviction, or continue to refuse them, defying a federal judge who could pummel her with fines or order that she be hauled off to jail."

    "She's going to have to think and pray about her decision overnight. She certainly understands the consequences either way," Mat Staver, founder of the law firm representing Davis, said on Monday, hours before a court-ordered delay in the case expired. "She'll report to work tomorrow, and face whatever she has to face."

      Exercising her religious beliefs over the civil rights of others is not lawful.
      She can warp her own children at home, but in public office she must adhere to the law.

      No, it not a 1st Amendment decision. She has that right in her personal life, but not as an elected government employee who is sworn to uphold the law. She is breaking the law.

      Here is the thing, she does have the right to chose under her 1st Amendment rights. Now, that County must hire someone who will issue the marriage licenses. That is that Period. She has a right to her beliefs just as much as Gays or anyone Else has a right to their beliefs. People need to stop this thinking that there way s the only way or to force another into doing things their way. I would think Gays wod be the one of the first to recognize this thinking and behavior and stand up for her right to chose and to come up with a suction other than slinging verbal insults, being heterophobic, and Bible bashing! America was created on the belief of tolerance and individual belief perhaps all of you including the Supreme Court should put your thinking caps on,,

      I really dont care. I have been doing the same job for over 40 years. I cant do or say anything i want or anything according to my beliefs. if you work in the Service area, no matter which one, you can not discriminate in any fashion even if it is your religious belief. I have to serve in my job or FIND ANOTHER ONE!! its pretty simple. Not all jobs can you do such a thing, she is no different then anyone else. do your job or find another one.. bye felicia

      This Woman doesn’t have any hard choices to make… She simply must walk in to the office on September 1st, and DO HER JOB… But I would be willing to bet that she will refuse…. This woman is NOT CHRISTIAN, NOT DOING THIS FOR RELIGIOUS REASONS…. SHE IS A HATE FILLED BIGOT who by her own admission will not serve those whom she hates!! She has NO CONSCIENCE, NO MORAL SCRUPLES other than the warped sense of Morals she has dreamed up… I think that fitting punishment would be for the Marshall’s office to have Officers there to enforce the court’s ruling and she can have one of two choices… either to issue the licenses and sign her name to them, or resign and have another court appointed clerk do the job she should have been doing in the first place replace her….but however using her name stamp on each license…. and the court should make her sit there during office hours and watch this being done…..So that Her name will be on each and every Same Sex License issued…..

      Pretty much the entire staff there in that office is related to her. She has ordered them to not issue licenses to any same sex couple. The family has upheld her orders. Asking for a different or deputy clerk hasn’t worked. Until now.

      She will likely become a martyr, there will probably be a Gofundme or other type of donation based account. However, this will be short lived. She will do time or resign. Either way, she’s screwed. And so is the family’s legacy in that office. If they chose to continue down the same path.

      There is now a clear direction for plublic servants: DO YOUR JOB. Religious beliefs have no place in government. You do not have the authority to impose your beliefs on other people under the eyes of the law. To do so is futile.

      The group representing her will only carry her as far as the monetary value will take her with them. When the donations start drying up, they will drop her.

      And again, she’s screwed.

      The fact is that Kim Davis, acting as an agent of government even without the Obergfell decision, should have been issuing marriage license to “same sex couples.” The reason that she should have been issuing licenses to same sex couples is the 14th Amendment, which states in a nutshell, that equality is the law of the land. Equality for all and not some! We are now seeing the last gasp of a belief system that demands inequality be practiced by its adherents. Unlike a secular nation, a theocracy has as its animus, a holey book that is interpreted by the prevailing monarch. Which we revolted against during the time of the Revolution against the British crown.

      When Davis is a representative of the government then it is NOT her religious beliefs but the governments EQUALITY rights of all of its citizens. Davis must choose to either be government representative or a private individual. The government has NO religious beliefs according to the first amendment. As a private individual she can practice her religious views outside of the government. But she cannot have it both ways. She deserves to be held in contempt of court and prosecuted for dereliction of duty for failing to perform her duties as the clerk. YOUR employer dictates what your duties are and you do not get to choose to perform them or not.
