‘The Legal Term for This Garbage’: Experts Bash ‘Pandering’ Trump-Nominated Judge Running to His Defense

Former prosecutors Cynthia Alksne and Glenn Kirschner sounded the alarm about the judge who granted Donald Trump’s demand for a “special master” to review the documents at Mar-a-Lago for any possible attorney-client privilege, while speaking with MSNBC fill-in host Michael Steele.

Kirschner pointed out that never in his 30 years practicing law has he ever seen a judge make a ruling before she’d heard from the opposing side.

“I went back and looked at U.S. District Judge Aileen Cannon’s order, and here is what she said,” Kirschner began. “Before I read this one sentence, Michael, mind you that she entered this tentative border before the Department of Justice prosecutors even had an opportunity to weigh in on the issue. She said quote, ‘The court hereby provides notice of its preliminary intent to appoint a special master in this case.’ And she has only heard from Trump’s defense team.”

He said that he’s never heard a judge even announce a “tentative ruling” before both parties have been heard.

“I think this indicates a judge who has extraordinarily poor judgment at best, and at worse is biased in favor of Donald Trump,” he continued. “As a footnote, I think it is worth mentioning that she was confirmed by the Senate, Mitch McConnell’s Senate after Donald Trump lost the presidential election.”

Alksne straight-up called it “pandering. I think that is the legal term for this garbage.”

She went on to say that there likely won’t be a so-called “special master” appointed. The government seems to be indicating that they’ve already searched through the documents with those who have the appropriate level of clearance. The appointment of a special master would mean that they had to find someone who has the highest level of clearance to handle such documents in a secure facility. The problem, however, is that there is no “special master” for executive privilege cases. The Justice Department is likely to appeal the decision to a higher court that will overrule Judge Aileen Cannon, and likely, publicly humiliate her.

“I do not think there will be a special master,” Alksne explained. “He has requested a special master, basically, because Rudy got. One in the attorney-client case. This isn’t an attorney-client privilege case. They started the wrong statutes as they are appointing a special master. There is no special master and executive privilege cases. And in the Presidential Records Act, executive privilege cases — those must be filed in D.C. This is filed in Florida. So, it is in the wrong jurisdiction. And there is no special master for classified information cases. So, I think it is only a matter of time before the pandering and by the Trump judge that there will not be a special master and this is a delay tactic.”

Kirschner called “pandering” the polite characterization.

There’s also the possibility of an obstruction of justice charge. Trump may have escaped accountability under the obstruction of Robert Mueller’s probe, but he no longer enjoys the protection of the executive branch and the Justice Department’s OLC decision not to indict a sitting president. Kirschner called the likely charges of obstruction “more than just a possibility.”

“The reason it is such an important criminal charge that the FBI agent who drafted the affidavit, in support of the Mar-a-Lago search warrant, included in what they are criminally investigating, is because it does not matter the nature of the documents,” said Kirschner. “They could be classified, they could have been magically declassified by Trump, not really but that is when he is claiming. They could be confidential secrets, secret SCI special access programs. They could be whatever, and the fact that Trump and company secreted them, concealed, them and refused to produce them even after being subpoenaed for them — it is what makes this obstruction of justice regardless of the classification of those documents.”

Alksne also said that the blacked-out portion of the affidavit is likely the “obstruction” part of the case against Trump.

“It is the heart and soul of this investigation,” she explained. “And the decision on prosecution ultimately will be based, in my, opinion on the obstruction if there is national security damage. That assessment is being undergone right now.”

Trump Battled to Go to Son’s Graduation – So Why Is He Speaking at a Fundraiser That Day?

Last month Donald Trump falsely told reporters Justice Juan Merchan had blocked him from attending his youngest son’s high school graduation, refusing to give him the day off from his required attendance at his New York criminal court case.

Justice Merchan had actually told Trump he would take the request under advisement, but Trump quickly ran to reporters painting the judge as heartless.

On April 15 Trump said, “it looks like the judge will not let me go to the graduation of my son who’s worked very, very hard and he is a great student.”

“It looks like the judge isn’t going to allow me to escape this scam. It’s a scam trial,” Trump alleged.

The Associated Press reported, “Trump then furthered his criticism of the judge on his Truth Social platform, writing in one post both that he ‘will likely not be allowed to attend’ and that ‘the Judge, Juan Merchan, is preventing me from proudly attending my son’s Graduation.’ He wrote in another post less than two hours later that he is ‘being prohibited from attending.'”

None of that was accurate.

Last week Judge Merchan granted Trump the day off from court to attend his son’s high school graduation.

But The Lincoln Project and others on Tuesday posted the announcement for “Minnesota’s 2024 Lincoln Reagan Dinner With Special Guest DONALD J. TRUMP” on Friday, May 17, 2024.

Trump, as The New Republic notes, will be the headline speaker at the event in Saint Paul, Minnesota, which starts at 5:00 PM.

The fundraiser offers supporters the opportunity to spend $100,000, which grants them “10 VIP Dinner Seats | 10 VIP Reception Passes | 3 Photo Opportunities with President Trump.”

Or, for example, for $50,000, a supporter can get a “Chairman’s Host Table – 10 VIP Dinner Seats | 10 VIP Reception Passes | 1 Photo Opportunity with President Trump.”

KARE reports “the visit is expected to be the former president’s first trip to Minnesota of the 2024 election cycle.”

Trump has strong motivation to head to Minnesota.

Over the weekend, as NBC News reports, “Top officials for former President Donald Trump’s campaign believe they can flip Democratic strongholds Minnesota and Virginia into his column in November, they told donors behind closed doors at a Republican National Committee retreat Saturday.”

Barron Trump’s graduation from Oxbridge Academy in Palm Beach, Florida reportedly will be the same day, May 17. Depending on timing, It’s possible Trump could fly from Florida to Minnesota to get to the fundraiser by 5 PM.

Marjorie Taylor Greene Delivers Demands to Johnson as Her Three-Person Posse Weakens

Under her threat to call up her motion to oust Speaker of the House Mike Johnson, U.S. Rep. Marjorie Taylor Greene (R-GA) met with the Louisiana Republican for several hours on Monday, delivering her list of demands, while knowing that Democrats have vowed to ensure her efforts to have him removed will fail.

Congresswoman Greene, a far-right extremist and self-proclaimed Christian nationalist, tried to build a faction of disaffected House Republicans but only two other GOP lawmakers have signed on to her “motion to vacate.” One of them, Christian nationalist U.S. Rep. Paul Gosar (R-AZ) did not show for her Monday meeting.

At the top of Greene’s list of demands is ending all aid to Ukraine, according to Punchbowl News. The second item is defunding Special Counsel Jack Smith’s criminal investigations into Donald Trump. And lastly, promising to adhere to the so-called “Hastert Rule,” putting on the floor for a vote only legislation that is supported by the majority of the Republican majority.

“Of course, the Senate would never take this up, and President Joe Biden would never sign any such bill including this provision if it somehow landed on his desk. Senior House Republicans privately admit this,” Punchbowl News reports.

Calling these maneuvers “cosplay” and “mostly theater,” Punchbowl notes: “Greene doesn’t really see those political realities as hurdles — or care. She wants to cause legislative crises and get media coverage.”

Johnson has the support of Donald Trump, along with, for now, the support of House Democrats including Minority Leader Hakeem Jeffries.

Greene and her number two supporter, U.S. Rep. Tim Massie (R-KY), possibly with Congressman Gosar – whose support for Greene’s motion to vacate appears to be wavering – are expected to meet again with Speaker Johnson on Tuesday.

The Guardian reports some observers are “suggesting the Georgia congresswoman is looking for an off-ramp,” and adds that Greene’s “lunchtime summit” could “finally offer clarity” on whether she “still intends to press ahead with her drive to oust speaker Mike Johnson, or accept a face-saving alternative that would give the impression of a win.”

Gosar’s apparent wavering has not gone unnoticed.

Punchbowl News’ Mica Soellner reports: “Rep. Paul Gosar tells me he’s still very much behind the MTV [motion to vacate] effort and missed today’s meeting due to a flight delay.”

He told Soellner: “If Marjorie wanted me to come, I would’ve been there.”

She notes Gosar did not commit to attending Tuesday’s meeting.

Meanwhile, from the non-Greene side of the House Republican conference, Fox News’ Chad Pergram reports on comments made by U.S. Rep. Don Bacon (R-NE).

Citing his Fox News colleague Brianna O’Neil’s reporting, he writes (not direct quotes): “GOP NE Rep Bacon on Greene’s efforts to remove Johnson: We don’t like it. We’d be angry about it because all it does is weaken all of us. And it’s it’s like 2 or 3 people working for the other side of the aisle…it appears to us, you know, the other side shooting this also foot right now over all the campus stuff. Joe Biden’s polling at 36%, the lowest of any president going back to 1952. So why jump in the way of that? And we’ve got 2 or 3 people are doing that. And it’s just a tactical and strategically. It’s not smart.”

Last week, Congresswoman Greene held a news conference and vowed to call up her motion to vacate, “next week, absolutely.”

On Monday, Greene alleged a “deal” has been made between Johnson and Speaker Emerita Nancy Pelosi.

‘I’m Not Talking About That Meeting’: Noem Implies She May Have Met With Kim Jong Un

Republican South Dakota Governor Kristi Noem continues to make media appearances promoting her new book, which has received massive attention for the story about her shooting to death her 14-month old dog, Cricket, and a goat, and her reportedly false claim she met with North Korean dictator Kim Jong Un.

But in discussing that apparent lie that appears in her book, Noem appeared to tell a few more – and seemed to suggest she may have actually met with Kim Jong Un but should not have put that meeting in her memoir. Experts have said it’s unlikely she did meet with him.

“The book is called, ‘No Going Back,’ but it sounds like the publisher, Center Street, is going back on a couple of the details in the book,” CBS Mornings told Noem.

“Well, I don’t believe so,” Noem replied.

After hearing the apparently false details of her alleged meeting with Kim Jong Un being read on-air straight from her book, Noem explained, “when I became aware of that we changed the content, and the future editions will be adjusted.”

Noem also said she’s “met with many, many world leaders, I’ve traveled around the world. I should not have put that anecdote in the book, and at my request they have removed it.”

She was then asked, “That specifically didn’t happen?” but Noem appeared to brush off the question.

“What I’m saying is I’m not talking about that meeting, I’m not talking about my meetings with world leaders, there are some that are in the book and there’s some that are not in the book.”

Asked, “Did you tell your ghost writer to write that?” Noem refused to answer the question.

“I specifically have worked on policy for over 30 years, and over that time I have traveled around the world and met with leaders around the world. And that anecdote, I’ve asked them to change the content, and it will be removed.”

“It’s a simple question, did you or did you not meet with Kim Jong Un?”

“That’s the answer that I have for you,” Noem replied.

She also did not tell CBS why she chose to put it in the book at all, if she knew it was false.

Noem does not mention that she recorded the audio book version for “No Going Back,” and would have read those words about meeting with the North Korean dictator aloud, yet apparently did not ask her publisher to remove it until a local newspaper, The Dakota Scout, published a report starting her account of the event was “in doubt.”

On Sunday, Noem first began to suggest the meeting might have taken place. Speaking with CBS’s “Face the Nation,” Axios reported, “Noem declined to talk about specific meetings she had with various world leaders, and never outright said she didn’t meet with Kim during the interview.”

A CBS News transcript of that interview shows “Face the Nation” moderator Margaret Brennan saying, “you released video of your recording of the audio book. you didn’t catch these errors when you were recording it?”

“Well, Margaret, as soon as it was brought to my attention, I took action to make sure that it was reflected,” Noem responded, before leaping into an attack on the media.

Also on Sunday, The Independent reported, “North Korea experts say it’s highly unlikely Ms Noem ever met the North Korean leader.”

“From 2011 to 2018, Mr Kim did not leave North Korea, according to University of Notre Dame professor and North Korea expert George Lopez.” The Independent added, “Benjamin Young, a professor at Virginia Commonwealth University and an expert on North Korea, told The Dakota Scout that Ms Noem’s account of meeting Kim was ‘dubious.'”

“I cover North Korea very closely, and I have never heard of Kim Jong Un meeting congressmen or congresswomen,” Young said.
