Hearing on Anti-Gay Bill Set for 1-Month Anniversary of Pulse Nightclub Attack

House GOP leaders are set to debate a horrific anti-gay bill on the one-month anniversary of the Orlando terror attack, despite a plea from more than 70 groups to cancel the hearing. 

Last month, we told you how Utah Republican Congressman Jason Chaffetz, chair of the House Committee on Oversight and Government Reform, had scheduled a hearing on the so-called First Amendment Defense Act (FADA) for July 12. 

As of Saturday afternoon, the hearing remained on the committee’s schedule for 10 a.m. Eastern time Tuesday, and Chaffetz had not responded to the letter from the ACLU, the Human Rights Campaign and dozens of otters local, state and national groups. 

“It’s outrageous that Congress would hold a hearing on legislation that would make it legal to discriminate against LGBT people with taxpayer dollars one month after the mass shooting that killed 49 people and injured 53 others at a gay club in Orlando,” said James Esseks, director of the ACLU’s Lesbian Gay Bisexual Transgender & HIV Project. “Congress should instead focus its efforts on protecting people against violence or discrimination, regardless of who they are or whom they love.”

The groups’ letter states that FADA,or H.R. 2802, “would permit unprecedented taxpayer-funded discrimination against LGBT people.”

“Among the legislation’s many harms, it could even allow any privately owned business to refuse to let a gay or lesbian employee take time off to care for their sick spouse, in violation of family and medical leave laws – a particularly appalling aspect given the many families currently caring for those who were injured in the Orlando shooting,” the letter states. 

The groups also note that similar legislation was recently blocked by a federal judge in Mississippi who said it violates both the First and Fourteenth amendments. 

“The misleadingly named First Amendment Defense Act has nothing to do with the First Amendment and everything to do with sanctioning taxpayer-funded discrimination against LGBTQ people,” said David Stacy, HRC’s government affairs director. “Enough is enough. It’s far past time to stop the legislative attacks on LGBTQ people and their families.”

In addition to scheduling the hearing on FADA, House GOP leaders have refused to hold votes on two gun control measures pushed by Democrats in response to the Orlando attack — which was the deadliest mass shooting in modern American history.

Former Trump White House Legal Advisor Who Testified at J6 Hearing Subpoenaed by Federal Grand Jury

Attorney and former senior advisor to then-President Donald Trump, Eric Herschmann, has been subpoenaed by a federal grand jury, after his explosive primetime testimony before the U.S. House Select Committee on the January 6 Attack last month.

“A federal grand jury investigating the Jan. 6 attack has subpoenaed Trump White House lawyer Eric Herschmann for documents and testimony, according to a person familiar with the matter,” Politico reports.

Herschmann, who also defended Trump as part of the first Senate impeachment trial, famously attended the “craziest meeting of the Trump presidency,” a post-election Oval Office meeting during which he allegedly told conspiracy theory promoter and Trump loyalist Patrick Byrne, “Do you even know who the fuck I am, you idiot?”

In February of 2021, less than one month after the January 6 insurrection, Axios reported on that meeting, adding this exchange between Herschmann and Trump’s “Kraken” attorney Sidney Powell:

“Powell, fixing on Trump, continued to elaborate on a fantastical election narrative involving Venezuela, Iran, China and others. She named a county in Georgia where she claimed she could prove that [voting machine manufacturer] Dominion had illegally flipped the vote,” Axios reported. “Herschmann interrupted to point out that Trump had actually won the Georgia county in question: ‘So your theory is that Dominion intentionally flipped the votes so we could win that county?'”

Herschmann, who is also becoming known for his colorful language, says he told coup memo author and far right attorney John Eastman to “Get a great f’ing criminal defense lawyer,” on January 7, 2021, one day after the insurrection.

“He started to ask me about something dealing with Georgia, preserving something, potentially for appeal,” Herschmann says in his testimony to the U.S. House Select Committee on the January 6 Attack, NBC News reported. “And I said to him, are you out of your f’ing mind? Right? I said I only want to hear two words coming out of your mouth from now on, ‘orderly transition.’”

“Now I’m going to give you the best free legal advice you’re ever getting in your life: Get a great f’ing criminal defense lawyer. You’re gonna need it.”

During the first impeachment hearing, Herschmann argued that Trump should not be convicted by the Senate, claiming he was no threat to the nation because his approval rating was high.

‘Should Expect to Be Indicted’: Giuliani Now Target of Georgia DA Investigation Into Efforts to Overturn Election – Report

Rudy Giuliani is now a target of Fulton County, Georgia District Attorney Fani Willis’ grand jury investigation into efforts by Donald Trump and his allies to overturn the results of the 2020 election, according to New York Times reporter Danny Hakim.

“Rudy Giuliani has been told that he is a target of the criminal investigation in Georgia into election interference. He is scheduled to testify in Atlanta later this week,” Hakim writes.

In June, the Times reported Giuliani had “emerged as a central figure in a Georgia criminal investigation of efforts by Donald J. Trump and his allies to overturn his election loss in the state, with prosecutors questioning witnesses last week before a special grand jury about Mr. Giuliani’s appearances before state legislative panels after the 2020 vote, the witnesses said.”

Last week Giuliani had tried to escape testifying, citing issues he claimed were related to travel, but The Times’ Richard Fausset, who co-wrote the June article with Hakim, reports “Giuliani’s lawyer says Rudy will definitely appear Weds before grand jury (there was talk of a 2nd doc’s note). Says attorney client privilege will be invoked re questions between Giuliani & Trump. ME: How will Rudy get here? LAWYER: ‘No comment’.”

Former federal prosecutor Renato Mariotti explains the term “target.”

“‘Target’ is a term prosecutors use to indicate that they are likely to indict someone. It has a specific meaning in this context. If Giuliani has in fact been told that he is a target of the Georgia investigation, he should expect to be indicted.”

‘Arsonist’ Trump Criticized for Ratcheting Up Anger in Fox News Interview as He Claims He ‘Will Do Whatever’ to Help

Donald Trump and Fox News are both being criticized for a Monday interview in which the right wing media outlet quotes the former president repeatedly ratcheting up the anger in his base over the FBI’s lawful execution of a search warrant while claiming he will do whatever he can to help the country.

“Interesting … stenographic choices in the morning’s lead story,” notes Wayne State journalism professor Fred Vultee, pointing out Fox News’ uncritical copying of whatever the former President told them despite appearing to be under criminal investigation for possible violations of the Espionage Act and other federal laws. Vultee, who teaches news editing, political communication, and content analysis, according to his bio, also notes Fox News incorrectly spelled dangerous as “dangrous.”

Media Matters’ Matthew Gertz described it as: “Arsonist tells accomplice that the fire has gotten out of hand.”

Attorney and former Republican Ron Filipkowski made a similar observation: “Arsonist Offers To Help Put Out Fire.”

In its “exclusive” article Fox News writes, “Former President Trump said he ‘will do whatever’ he can ‘to help the country,’ after the FBI’s raid of his Mar-a-Lago home last week, telling Fox News Digital that the ‘temperature has to be brought down,’ while stressing that the American people are ‘not going to stand for another scam.'”

Rather than trying to bring the temperature of his supporters down, Trump appeared to stoke the fire.

“The country is in a very dangerous position. There is tremendous anger, like I’ve never seen before, over all of the scams, and this new one—years of scams and witch hunts, and now this,” Trump told Fox News. “There has never been a time like this where law enforcement has been used to break into the house of a former president of the United States, and there is tremendous anger in the country—at a level that has never been seen before, other than during very perilous times.”

“I’ve never seen anything like this,” Trump continued. “It is a very dangerous time for our country.”

Visiting Georgetown University professor Thomas Zimmer observes: “Unity; avoiding tensions; lowering the temperature – It all sounds fine in a vacuum. But in the concrete context of the current political conflict, it all basically means the same thing: Impunity for Trump, surrendering to the Right; sacrificing democracy and the rule of law.

Fox News also reports “Trump said he had his representatives reach out to the Justice Department to offer to help amid outrage over the FBI’s unprecedented raid on his private residence last week,” and he “told Fox News that his team ‘has not heard yet’ from the Justice Department on whether they will accept his offer for help.”

“People are so angry at what is taking place,” Trump added. “Whatever we can do to help—because the temperature has to be brought down in the country. If it isn’t, terrible things are going to happen.”

Trump re-upped the claim that the FBI could have planted evidence, even after falsely declaring all documents were legally declassified.

“They could take anything they want, and put anything they want in,” Trump said, adding, baselessly, they “could have planted anything they wanted.”

Fox News did not appear to offer any clarification or push back against anything Trump said. It also offered no balance, including any quotes from legal experts or political experts, nor did the Fox News article offer any reaction from the left, where there too is tremendous anger over Trump allegedly taking and refusing to return 35 cartons of materials from the White House, including highly classified documents, according to the federal warrant and news reports.

The Fox News article ends by saying, “sources close to Trump told Fox News that the former president will soon be making an announcement about a potential presidential run in 2024.”
