In what could become a landmark and historic case President Donald Trump’s personal attorney officially petitioned the U.S. Supreme Court to block a subpoena ordering his tax returns and financial records to be handed over. Should the Supreme Court accept the case, it could determine if presidents hold blanket criminal immunity while in office.

“If the justices agree to consider the case, it will pave the way for a landmark dispute over the reach of presidential immunity in the midst of the 2020 presidential campaign and a historic impeachment battle in Congress,” CNBC reports.

The subpoena comes from New York prosecutors investigating if Trump’s alleged hush money payoffs were illegal.

The filing by the president’s private lawyers represents a historical moment that tests the court’s independence and highlights the Constitution’s separation-of-powers design,” The Washington Post adds.

The Court could also refuse to hear the case.
