Trump Rails Against 9th Circuit for Upholding Decision to Block His Muslim Travel Ban

Suggests He Will Appeal To The Supreme Court

President Donald Trump took to Twitter early Tuesday morning to rail against his favorite judicial target: the 9th Circuit court of Appeals. Trump lamented the court “did it again” by upholding a ruling blocking the second version of his Muslim travel ban on Monday.

“Well, as predicted, the 9th Circuit did it again,” Trump said via Twitter. “Ruled against the TRAVEL BAN at such a dangerous time in the history of our country. S.C.”

Trump seemed to be saying he will appeal to the Supreme Court in adding “S.C.” at the end of his tweet.

The unanimous ruling stated in part that Trump’s executive order violated the law, strengthening the case against his ban by stating the president exceeded his statutory authority. It also pointed to a recent tweet Trump posted.

Back in April, Trump lied about the 9th circuit’s record, tweeting, “close to 80%” of their cases were overturned by SCOTUS. In reality, the facts are clear.

As NCRM reported in April, out of the very few (less than 1%) 9th Circuit cases the Supreme Court accepts for review, 79% are overturned. If you think that’s high, it’s not. 85% of the 11th Circuit cases accepted for review are overturned, and 87% of the 6th Circuit’s cases accepted for review are overturned.

President Trump signed his first Muslim travel ban on January 27, saying the administration needed 90 days to put into place his extreme vetting program. The 90 days are long gone, but last week they admitted they have not done anything they claimed they would with the vetting program.
