“So-Called” Appeals Court Judges Refuse To Reinstate Trump’s Muslim Travel Ban

9th Circuit Denies Administration’s Request For An Emergency Stay

A federal appeals court early Sunday denied the Trump administration’s request for an emergency stay of a district judge’s ruling halting the president’s Muslim travel ban. 

The 9th U.S. Circuit Court of Appeals instead requested arguments from both sides by Monday so that it can fully consider the motion. 

U.S. District Judge James Robart on Friday halted the travel ban, prompting the Justice Department’s appeal. The Trump administration could also appeal Robart’s decision to the U.S. Supreme Court, but for now those previously affected by the ban should be able to come to the U.S. freely, according to the Washington Post. 

“We’ll win,” Trump told reporters Saturday night, according to the Associated Press. “For the safety of the country, we’ll win.”

Earlier Saturday, Trump blasted Robart as a “so-called judge,” and vowed that his “ridiculous” ruling “will be overturned.” 

Democrats criticized Trump for his attack on Robart. 

“The president’s hostility toward the rule of law is not just embarrassing, it is dangerous,” Vermont Democratic Sen. Patrick J. Leahy said in a statement.

Robart was nominated by President George W. Bush and confirmed in a 99-0 vote of the Senate.

The two 9th Circuit judges who denied the Trump administration’s request for an emergency stay were William Canby Jr., a Jimmy Carter appointee, and Michelle Taryn, a Barack Obama appointee. Read their full decision here.
