Breaking: North Carolina Republicans File Bill to Repeal HB2 – With Conditions
Mandates 6 Month Waiting Period For New Protections
North Carolina Republican Senate Leader Phil Berger, has just filed a bill to repeal the unconstitutional law known as HB2, nearly five hours after lawmakers were to begin the repeal process.
The legislation repeals HB2, but enacts a six-month waiting period before any locality can legally enact ordinances “regulating employment practices or regulating public accommodations or access to restrooms, showers, or changing facilities.”
Calling the measure “constitutionally suspect,” Chicago-Kent College of Law professor Anthony M. Kreis suggests the ban might be a violation of the 14th Amendment:
This type of preemption provision is unconstitutional under the 14th Amendment. #NCpol #HB2 #repealhb2 #ncga https://t.co/CR0sPUGouU

A cooling off period for civil rights is a denial of civil rights. The NCGA should not get away with this. Democrats do not play ball. #HB2

This perpetuates the same constitutionally suspect injustice. A delay of civil rights is a denial of rights. https://t.co/lJaVpQvSlu

The House and Senate are expected to return to session shortly, presumably to debate the bill, which is not in keeping with the agreement made between Governor-elect Roy Cooper and Republican leadership in the legislature.
