Judicial Commission Calls for Chief Justice Roy Moore to Be Removed From Alabama State Supreme Court

Roy Moore May Lose His Job as the Chief Justice of the Alabama Supreme Court – Again 

Alabama Chief Justice Roy Moore is in legal trouble for his response to two 11th District court rulings which legalized same sex marriage in Alabama and to the Supreme Court’s Obergefell ruling, which legalized marriage for same-sex couples nationwide.

The Alabama Judicial Inquiry Commission (JIC) brought a case against Moore in May after an ethics complaint from the Southern Poverty Law Center (SPLC). On Friday, in response to Moore’s attempt to have the charges dismissed, the JIC asked again that he be removed from the bench, as AL.com reports.

Moore issued a ruling that attempted to ban same-sex marriage in the state once it was already legal, leading to mass confusion among probate judges and the rest of the country as counties individually were caught between Moore’s ruling and that of the federal court, with many simply refusing to issue marriage licenses at all.

Moore is currently suspended while the complaint against him is settled. A hearing is set for August 8 for Moore to make a case to have the charges dismissed.

In the meantime, Moore has enlisted the aid of Liberty Council to fight the charges. In response to the SPLC complaint, Moore held a press conference to explain that his position has been misinterpreted. He then went on to attack a drag queen named Ambrosia Sterling, who spoke out against Moore’s ruling.

Liberty Council issued a statement shortly after the press conference asking for the Judicial Inquiry Commission to “dismiss unfounded and politically motivated complaints filed against him by the Southern Poverty Law Center, People for the American Way, the Human Rights Campaign, atheists, and homosexual activists.” The Liberty Council statement attacked Sterling as well.

After the JIC filed charges against Moore, Liberty Council filed a federal lawsuit against the JIC, asking that the law suspending judges from the bench while they face charges for ethics violations be declared unconstitutional and that Moore be immediately reinstated.

The complaint against Moore accuses him of “showing disrespect for and failing to acknowledge the authority of a United States District Court’s injunction,” and “abusing his authority as chief administrative officer of Alabama’s court system.” 

As AL.com reports, if Moore is removed from the bench, it will be the second time. In 2003, Moore refused to remove a Ten Commandments monument from the Alabama Supreme Court building after it was declared unconstitutional.
