Breaking: Texas to Sue Obama Administration Over Transgender Students Nondiscrimination Guidance

‘Major Lawsuit’ Announcement Expected Today

Attorney General Ken Paxton is expected to announce today Texas is filing a lawsuit against the Obama administration over its transgender students guidelines protecting the civil rights of transgender students. Paxton on Tuesday sent emails to local news outlets announcing a “major lawsuit” filing.

The Dallas Morning News Tuesday night reported Paxton “has scheduled a 2 p.m. news conference Wednesday in Austin. WFAA-TV (Channel 8) reported Tuesday evening that Paxton would announce the legal challenge then.”

“This month, Paxton joined seven other states filing an amicus brief in an ongoing lawsuit over a Virginia school district bathroom policy,” the Dallas newspaper noted. 

“One’s sex is a biological fact, not a state of mind,” Paxton said in a written statement about the brief. “If this radical new interpretation by the Department of Education is permitted to go unchallenged, schools may no longer be able to maintain separate restrooms, showers, and locker rooms on the basis of students’ actual sex. Title IX permits all schools to maintain separate facilities, including bathrooms and locker rooms, and I will defend that principle.”

Saying the Obama transgender guidance “puts our children at risk,” Paxton told a far right wing website last week Texas will “fight back in every way we can” if the state loses federal funding over its policies against transgender students

“We consider this an extremely risky policy,” Paxton told LifeSiteNews. “It’s unconstitutional and it’s outside of the authority of the president to do this from his position,” a claim others dispute. 

“We will likely see some school districts in our state adopt policies that are…in direct opposition,” to the transgender guidelines, Paxton said. “And those school districts have the right to ask the Attorney General’s office to represent them in any litigation with the Administration…I would expect that at least one school district in the state, probably many, will adopt policies and some of them will ask us to help them.  And if they ask, we will help, and we will be actively involved in litigation against the Obama administration.”

The Republican Attorney General himself is engaged in a different legal case: He was indicted last summer by a Texas grand jury and charged with securities fraud.
