Kim Davis’ Lawyers Threaten To Sue NJ High School Over Proposed Transgender Policy

Florida-Based Liberty Counsel Claims Its Actions Will ‘Prevent Irreparable Harm to Cherished Liberties’

Florida-based anti-LGBT Christian law firm Liberty Counsel, which infamously represented Kim Davis last year, is now threatening to sue a New Jersey public high school district that is considering allowing transgender students to use restrooms and locker rooms and play sports on teams that correspond to their gender identity.

Liberty Counsel, which has also offered to defend North Carolina‘s unconstitutional anti-LGBT law, HB2, sent a letter to the Pascack Valley Regional High School District claiming its intervention is necessary to “prevent irreparable harm to cherished liberties,” The Record reports.

Schools Superintendent P. Erik Gundersen called “a threat,” and accused Liberty Counsel of having a “particular bias.” The Record adds that “school district attorneys assured him the proposed policy is on firm legal ground.”

Some parents have expressed concern over the proposed policy, and the Board of Education tabled a February 22 vote to allow further discussion. There is a school board meeting Monday afternoon, and a scheduled vote the following week.

The proposed policy also states “the school and district staff shall address the student by the name and pronoun corresponding to the student’s gender identity that is consistently asserted at school.” The Record reports Liberty Counsel’s letter claims “teachers ‘who have religious convictions about telling the truth’ should not be forced to call a person who was born male ‘she’ because ‘it is a lie.'”

Liberty Counsel has a less-than stellar record for truth telling. The group’s chairman, Mat Staver, last year falsely claimed 100,000 Christians in Peru attended a prayer rally for Kim Davis. Staver even provided a photograph that he falsely claimed was the Davis prayer rally. He was later forced to retract his claims.

Liberty Counsel, which apears on the Southern Poverty Law Center’s list of anti-gay hate groups, was contacted about the proposed policy by the head of the New Jersey chapter of the Eagle Forum, Carolee Adams. The Eagle Forum is a decades-old far-right wing group founded by anti-feminist activist Phyllis Schlafly.
