Hate Group Says NC Anti-LGBT Law Not Unconstitutional Because Gender Identity Not in Constitution

Family Research Council’s Peter Sprigg Gets Schooled by CNN’s Chris Cuomo

Family Research Council spokesperson and Senior Fellow for Policy Studies Peter Sprigg insists North Carolina‘s anti-LGBT law, HB2, can’t be unconstitutional because gender identity doesn’t appear in the Constitution. No doubt similar arguments were made about bans on same-sex marriage, yet, the Supreme Court decided they too were unconstitutional.

“I think it’s ridiculous to argue that this North Carolina law is in any way unconstitutional,” Sprigg told CNN’s Chris Cuomo Monday morning. “The concept of gender identity appears nowhere in the constitution as a protected category, and even the statutory law like the law against sex discrimination that was adopted in 1964, it strains credulity to argue that it was part of the legislative intent in 1964 to protect gender identity or transgender persons under that law.”

CNN’s Chris Cuomo offered one of several reasons why Sprigg is wrong.

“We do know that transgender has been in many cases applied as a Title IX requirement category. So, that would be the legal basis of this contravening federal law that would then trigger funding mandates about place that receive federal funds.”

North Carolina’s own attorney general has called HB2 “unconstitutional.”

Sprigg has said “criminal sanctions against homosexual behavior” should be enforced, and gained national notoriety when he told MSNBC’s Chris Matthews that he agreed “gay behavior should be outlawed.”

Of course, CNN needs to stop inviting members of certified anti-gay hate groups, like Family Research Council, on to its network all together. Anti-gay hate groups earn that label by repeatedly spreading lies and false information about LGBT people, which should also automatically disqualify them from appearing on national TV as “experts.”
