Utah Judge’s Ruling Removing Foster Child From Gay Parents Opposed By Everyone Involved

Every interested party disagrees with a Utah judge who ordered a foster child removed from a same-sex couple’s home and place with heterosexual parents.

7th District Juvenile Court Judge Scott Johansen this week ordered a 1-year old baby girl to be removed from her foster parents home and place with heterosexual parents because, he claims, research shows children perform better when raised by straight parents.

Every interested party opposes the judge’s decision.

The foster parents, April Hoagland and Beckie Peirce, who are licensed by the Utah Department of Child and Family Services (DCFS), have said they will oppose the judge in court. 

The head of the DCFS also opposes the jdge’s ruling, and overnight filed a motion asking him to reconsider. 

If the judge does not and upholds his ruling to remove the child by Tuesday evening, DCFS says they will file an appeal.

Even the baby girl’s biological mother opposes the judge’s ruling. She reportedly had asked the couple, April and Beckie, to foster her child.

Republican Governor Gary Herbert, who legally has opposed same-sex couples adopting children, also disagrees, telling reporters Thursday he is “a little puzzled” by the judge’s action.

“I expect the court and the judge to follow the law. He may not like the law, but he should follow the law,” Fox 13 reports. Herbert added, “the judge should not interject his own personal beliefs and feelings and supersede the law.” 

CNN legal analyst Jeffrey Toobin Friday morning said, based on the detail he has before him, the judge’s ruling is “vulnerable to being overturned.”

Every reputable study has found that children raised by same-sex parents do at least as well as their peers raised by different-sex parents. The judge refused to release the basis of his claim, but several studies that support it have been widely and thoroughly debunked.
