Lawsuit Filed Against Mike Huckabee For Playing ‘Eye Of The Tiger’ At Kim Davis Rally
Mike Huckabee is being sued by the founding member of Survivor after “Eye of the Tiger” was played at Kim Davis’ rally celebrating her release from jail.
As promised in September, Survivor frontman Frankie Sullivan has decided to sue Mike Huckabee for playing his band’s iconic song, “Eye of the Tiger” at the rally celebrating Kim Davis’ release from jail.
The lawsuit was filed today in federal court in Illinois, by Rude Music, Sullivan’s company. Sullivan is a founding member of Survivor, and co-author of the song. “Eye of the Tiger,” which was the theme song for Rocky III, went platinum in 1982, and was the number one song on Billboard’s Hot 100 for six weeks, is one of the best-selling singles of all time.
The Wrap reports Sullivan’s lawsuit “claims that Huckabee violated the copyright of the song by allowing it to play when he escorted Davis.” The lawsuit says Huckabee should have known he was violating a copyright because he is a “media-savvy business owner,†who has written over a dozen books, and “is sophisticated and knowledgeable concerning the copyright laws.â€
Back in September, Sullivan took to Facebook telling his Facebook fans in no uncertain terms just how outraged he was.
“NO! We did not grant Kim Davis any rights to use ‘My Tune -The Eye Of The Tiger,'” Sullivan wrote on the band’s Facebook page.
“I would not grant her the rights to use Charmin! C’mom Mike, you are not The Donald but you can do better than that,” he added, leaving one last send-off. “See Ya really SoooooooonnnnnnN!!!!!!”
A cease and desist letter reportedly followed, and now, that day has come.
Politico notes Sullivan’s “Rude Music filed a complaint against Newt Gingrich in 2012 for allegedly using the Grammy award-winning track at several events going back to 2009.”
