Pres. Huckabee Would Have Sprung Kim Davis From Jail Immediately And Begun Proceedings Against Judge

Mike Huckabee once again displays his extreme ignorance of American jurisprudence.

For months Mike Huckabee has been chastising almost everyone in America for not remembering what (he claims) they were taught in their “ninth grade civics classes,” because “the Supreme Court is not the Supreme Being” and only Congress, not the courts, can make a law.

He argues, incorrectly, that just because the Supreme Court struck down all bans against same-sex marriage, because there is no federal law stating same-sex marriage is the law of the land, it is not.

That’s of course akin to stating that because there’s no federal law stating the eating of apples is legal, it is not, but Mike Huckabee insists.

On Friday, the Republican presidential candidate characterized the Supreme Court’s marriage ruling as both “illegal” and “unconstitutional,” and promising that if he is elected president, same-sex marriage will not be “the law of the land.” 

“It is not the law of the land because it has not been affirmed by the people’s representatives,” Huckabee claimed, as he often has, incorrectly. “There is nothing in the Constitution that gives the Supreme Court the authority to decide what states should do about marriage. Nothing.”

Huckabee, speaking with the American Family Association‘s AFR radio network, claimed that if he had been president when Kim Davis was taken into custody, she never would have been booked, and if she were, he would have ensured she was sprung from jail immediately. Additionally, Huckabee promised that he would immediately have “proceedings started against the judge who overreached,” claiming Davis was “put in jail because she’s a Christian.” 

Of course, it’s not even clear how he would block Davis from being booked or jailed, and each of the statements Huckabee made would force a constitutional crisis.
