Kim Davis’ Attorneys (Finally) File Appeal Of Her Jailing

Kim Davis’ attorneys finally got around to filing an appeal of her contempt of court charge that landed her behind bars.

On Thursday, just past 1:00 PM, U.S. District Court Judge David Bunning ordered federal marshals to handcuff Kim Davis and place her behind bars until he removed his order of contempt of court against the Rowan County clerk. The charge came after Davis repeatedly refused to issue marriage licenses to same-sex couples because doing so violates her religious beliefs, she claims.

More than 24 hours later, at 2:30 PM, Davis’ attorneys held a press conference berating the judge, bandying about claims of “religious liberty,” and promising to file an appeal by the end of business Friday.

On Sunday night, Davis’ Liberty Counsel attorneys filed that motion.

The three-page document makes no legal argument to the 6th Circuit Court of Appeals as to why their client should be released from jail. It actually is merely an amended notice of appeal from last month. 

Mat Staver, the head of Liberty Counsel who lost a debate with MSNBC’s Chris Hayes Friday night, has repeatedly made the claim that Davis’ right of due process are being violated.

“Ms. Davis had no notice of it. The plaintiffs had no notice of it,” Staver says. “Without proper notice or proper due process, he decided to incarcerate her.”

Of course, smelling opportunity to bash the LGBT community, whose constitutional right to marry was refused for centuries, the religious right have encircled Davis as a martyr.

“She’s not going to resign, she’s not going to sacrifice her conscience, so she’s doing what Martin Luther King Jr. wrote about in his Letter from the Birmingham Jail, which is to pay the consequences for her decision,” Staver said, as he tried to obtain a discount the amount of that payment.

Amid cries of “judicial tyranny,” on Sunday, Gov. Mike Huckabee announced his anarchy-based claim that Americans, like Kim Davis, should be free to ignore a law unless “it’s right.” The “right” part apparently is in the eye of the beholder.

Over the weekend an account appeared on Twitter that many, especially those from the religious right, but several reporters as well, believed to be Kim Davis. It included tweets comparing her to Rosa Parks and Martin Luther King, Jr. It was later proved fake.

Tomorrow, Huckabee will travel to Kentucky to appear at a “free Kim Davis” rally he helped organized.
