Huckabee: Same-Sex Marriage Is ‘Illegal’ Because It’s ‘Left The Country In A State Of Confusion’

Mike Huckabee has enlarged the extent of his lack of understanding of American law by declaring the Supreme Court’s marriage ruling is “illegal” because he’s confused about it.

Even the best minds can get confused over some legal rulings. That’s one of the reasons you can ask a lawyer, or a law professor, or some other legal expert for advice. Or hire them.

But the Supreme Court’s Obergefell decision was not confusing, or especially complicated. The June ruling that found same-sex couples do indeed have a civil right to marriage made that fact clear – like it or not – to everyone. Everyone, except Mike Huckabee.

The former Arkansas governor and current GOP presidential candidate for months now has been traveling the country expressing his mistake legal “expertise” that is pure hogwash. 

Huckabee says just because the Supreme Court struck down the bans nationwide on same-sex marriage does not mean it’s actually legal for same-sex couples to marry, since no legislative body since has written and passed a law saying so. In Huckabee’s world, crossing the street would be illegal unless there were a specific law supporting it.

This week, Huckabee crossed a huge line, stating that the Supreme Court’s Dred Scott decision, which stated African Americans can never be citizens, was still “the law of the land,” despite the fact that the 14th Amendment was passed to counteract that ruling.

Yesterday, Huckabee expanded his ridiculously ignorant jurisprudence arguments.

Talking with hate group head Tony Perkins about the Kim Davis case, Huckabee said the governor of Kentucky could solve the entire problem by changing the marriage forms county clerks use. And then, flip-flopping, he questioned the legality of that act.

“The governor can fix this very simply by simply saying he’ll change the form,” Huckabee told Perkins. “Now the question is, does he have the authority to do that? And if so, under what authority?”

“This is where this all gets very confusing. And it’s why the haste to rush into implementing same-sex marriage is so ridiculous and, frankly, Tony, it’s why it’s so illegal is because this has left the whole country in a state of ambiguity and confusion.”
