This morning Mike Huckabee got into a heated argument with MSNBC’s “Morning Joe” Scarborough and Mika Brzezinski over Kentucky clerk Kim Davis.
Mike Huckabee appeared on MSNBC’s “Morning Joe” this morning, and slammed Hillary Clinton for what he claimed was the Democratic frontrunner disregarding “the rule of law” when using a private email account. Mika Brzezinski then turned the conversation to Kentucky clerk Kim Davis, suggesting Huckabee is being hypocritical by attacking Clinton for what he says is ignoring the rule of law, but heralding Davis for ignoring it.
Brzezinski and Joe Scarborough appeared stunned that Huckabee does not understand the U.S. Supreme Court has the authority to interpret the U.S. Constitution, and their decisions become the “law of the land.” Huckabee, as he repeatedly has done ever since the high court ruled on same-sex marriage, has claimed that the Obergefell decision is merely an “opinion,” and until Congress passes and the president signs a bill stating same-sex marriage is legal in all 50 states, it isn’t.
“We’re bordering on judicial tyranny here,” Huckabee insisted, because the Supreme Court ruled on same-sex marriage and states are now following that decision.
“Governor,” Scarborough, incredulous at Huckabee’s obstinance, said, “you know that the Supreme Court doesn’t have to have Congress pass statutes for their interpretations of the Constitution that immediately becomes law of the land and supersedes all state laws,” he posited, somewhat flabbergasted. “Right? That’s basic constitutional law.”
Huckabee disagreed.
“Look, you would have hated Lincoln,” the GOP presidential candidate claimed, because Lincoln freed the slaves via an executive order that was in conflict with Dred Scott.
“Jefferson warned against judicial tyranny,” Huckabee added.
Later, calling Kim Davis “hypocritical,” she asked Huckabee why he said “thank God for” Kim Davis. “Do you actually want to see other court clerks doing this?,” she asked, puzzled.
“I want people to stand up for their convictions,” Huckabee responded.Â
“Do you want them to follow the law?,” she asked.
“Again, it is the interpretation of five unelected lawyers on the [Supreme] Court,’ Huckabee said.
A stunned Brzezinski put her hands up to her head.
“Those lawyers are Supreme court justices,” Scarborough reminded the former Arkansas governor. “Do I decide what laws I want to follow and what laws I don’t want to follow?”
“No,” Huckabee said, “we don’t have that option, but I’m asking you, tell me the statute, tell me the specific law” that makes marriage for same-sex couples legal, he demanded.
Again, a now shocked and incredulous Brzezinski looked aghast.
Scarborough reminded Huckabee there was no statute passed “after Brown v. Board of Education was passed, but it became the law of the land immediately thereafter and Dwight Eisenhower got the National Guard enacted because that was the law of the land.”
Later, Huckabee insisted same-sex marriage is “long from being settled.”
“I believe this case in Kentucky may end up being the first case in which a person for their Christian convictions is going to be put in jail if they refuse to bow to a decision,” Huckabee said.
