Breaking: Kim Davis Files New Court Documents Accusing Governor Of ‘Commandeering’ Her Office

Kim Davis is changing her focus, now directing her attention to the governor of Kentucky, against whom she previously filed a lawsuit.

Kim Davis‘ legal strategy appears to be clear now: tie up the federal court system with motions in an attempt to keep her out of jail, and if that doesn’t work, to allow her attorneys to claim her due process rights are being violated – a claim they made previously, when she was jailed for contempt of court.

Late Thursday night, Davis’ Liberty Counsel attorneys filed a 40-page document that accuses her fellow Democratic Governor Steve Beshear of having “commandeered” all of the state’s county clerk’s offices and having “usurped control of Kentucky marriage law,” according to the AP.

In June, immediately after the Supreme Court ruled same-sex couples have the same right to marriage as different-sex couples, Gov. Beshear sent a memo to all 120 county clerk offices directing them to follow the law of the land and issue licenses to same-sex couples.

But since county clerks are elected and do not report to anyone – including the governor – besides their constituents, that memo was effectively little more than a request. 

Davis’ attorneys do not see it that way. They previously filed suit on her behalf stating the governor’s memo violated her First Amendment rights, and are also accusing him of violating Kentucky’s religious freedom law by not making an accommodation for Davis, exempting her from having to issue marriage licenses.

When Davis was elected last November the U.S. Supreme Court had already announced it would be taking up same-sex marriage, and most believed it would find a right to marriage for same-sex couples. In January Davis admits she began to lobby the state legislature to pass a law exempting clerks with religious objections from having to issue marriage licenses, but was unsuccessful. 

After the Supreme Court handed down its marriage ruling in Obergefell, Beshear told clerks if they were unwilling to perform their duties they should resign. 

“The courts and the voters will deal appropriately with the rest,” Beshear announced.

Davis’ Liberty Counsel attorneys, on Thursday labeled Beshear’s warning as “ominous,” the AP reports this morning, “and suggested that Beshear’s directive for clerks to abide by the Supreme Court’s decision forced Davis to defy the court and wind up in jail.”

In her interviews with ABC and Fox News this week, Davis said she is prepared to go to jail again.

Davis will be speaking tonight at the Family Research Council’s Values Voter Summit, where she will receive a religious liberty award.
