UPDATED: Kim Davis May Have Violated Court Order By Altering Marriage Form Charges Deputy Clerk

An attorney for one of Kim Davis’ deputy clerks says that Davis’ actions may violate a federal judge’s orders to not interfere.

Brian Mason is a deputy county clerk in the Rowan County office run by Kim Davis. Mason has been hailed as a hero because he told a federal judge that he would issue marriage licenses to same-sex couples with or without Davis’ approval. Moments ago, Mason’s attorney announced that he believes Davis may have violated U.S. District Court Judge David Bunning’s directive to not interfere, directly or indirectly, with the issuance of marriage licenses.

When Davis, who was jailed on a contempt of court charge for refusing to issue marriage licenses, returned to work, she acknowledged she had altered the marriage license form to remove her name and the name of the county from the form, as you can see below.

Mason’s attorney says his client is concerned and wants to be certain the licenses he is issuing are legal and valid.

Attorney Richard Hughes, the AP reports, “said the altered forms would not be valid and thus constitute an attempt to violate the judge’s order,” but Chris Geidner, Buzzfeed’s Legal Editor, notes via Twitter more specifically that Mason’s attorney charges that the changes to the form “may have raised” to a level of interference.  

UPDATE I: 5:41 PM EDT –

This updated AP report sheds more light:

“On Friday, Mason’s attorney told the judge that when Davis returned to work Monday she ‘confiscated all the original forms’ and replaced them with forms that delete her name, the name of the county and all references to the deputy clerks. The new form has Mason’s name and a place for him to write his initials but not his signature.”

“It also appears to this counsel those changes were made in some attempt to circumvent the court’s orders and may have raised to the level of interference against the court’s orders,” attorney Richard Hughes wrote. “Mr. Mason is concerned because he is in a difficult position that he continues to issue the licenses per the court’s order … which had some remote questionable validity, but now with these changes may in fact have some substantial questions about validity.”
