A jury has just passed down its sentence in the trial of a mass shooting in a Colorado movie theater that left 12 people dead.
Last month a jury found James Holmes guilty of first degree murder in his 2012 shooting massacre at an Aurora, Colorado movie theater. After Holmes opened fire, 12 people died and another 70 were injured. Holmes was declared guilty of 24 counts of first-degree murder and 140 counts of attempted murder.
Holmes’ attorneys argued that he was not guilty by reason of insanity, but on Monday jurors voted to not take the death penalty off the table.
Tonight, they could not reach a unanimous death penalty verdict, giving James Holmes life in prison without possibility of parole.
The AP had reported earlier this week that the judge had detailed more than 50 mitigating factors, including:
“All experts agree that Holmes suffers from schizophrenia, is not faking the illness that caused the events, and if he had been healthy, the crimes would not have taken place.”
The massacre took place July 20, 2012, at a midnight screening of “The Dark Knight Rises.”
