“Don’t let it get on you, he probably has AIDS, the faggot.” That’s what a New York City man claims the police said as they were pinning him to the ground.

A gay Staten Island man says he was left with a broken nose, two black eyes, cuts to his face and body, and damage to his foot after four police officers forcefully pulled him out of his house and shouted anti-gay slurs. The police, on the other hand, are claiming a very different story.

Louis Falcone, 31, shares a home with his 66-year-old mother and according to the Daily News, Falcone and his brother had an argument at the house in the middle of the night, resulting in the police being called to the home.

Falcone said his “obnoxiously drunk” brother came home at about 4:30 a.m. “We had words,” he said. “I was yelling at him; he was yelling at me.” According to Falcone’s timeline, the cops arrived an hour after his brother left.

“As I’m talking to them through the screen door, they’re saying to come outside,” he told the Daily News. “I said, ‘For what?” As his dog started barking, Falcone claims one of the cops said, “Get your dog out of here or I’ll f—— kill it!” prior to yanking him out of the house and throwing him on the concrete floor.

“While I was on the ground, I had mud and blood in my mouth,” Falcone said. “One (of the cops) said, ‘Don’t let it get on you, he probably has AIDS, the faggot.’” Falcone also claims the police called him “fag” and “faggot” while roughing him up in front of his house.

A video recorded by a neighbor across the street does show the cops holding Falcone on the ground, but the audio is not clear, so it’s hard to tell what anyone said. While it’s also difficult to tell if Falcone was roughed up, pictures do show physical injuries on his body after the event.

The Daily News reports that a police source familiar with the incident said the mother called 911 about her two sons fighting, and that Falcone was there, injured and banged up when they arrived. The source also said that Falcone was confrontational, uncooperative, and spit in one officer’s face before being taken into custody.

Falcone was never charged for anything and plans to sue in federal court for civil rights violations.

“How can you do that – four people on one skinny, scrawny little guy?” Eric Subin, Falcone’s lawyer asked. “They’re criminals; they belong behind bars.”
