The National Organization For Marriage’s Brian Brown is demanding Justice Ruth Bader Ginsburg recuse herself from the upcoming same-sex marriage case.
National Organization For Marriage (NOM) President Brian Brown has just released a scathing attack on Ruth Bader Ginsburg, demanding the Supreme Court Justice recuse herself from the upcoming same-sex marriage case the Court will hear in April.
“Justice Ginsburg has brought disrepute on the Supreme Court and eliminated any pretext that she will approach the marriage issue with an open mind when it comes before her. Because of this prejudice, federal law requires her to remove herself from hearing the cases,” Brown said.
Of course, the NOM president once again has displayed an embarrassing lack of understanding about federal law. There is no law that “requires her to remove herself from hearing the cases,” as the Supreme Court is exempt.
“If she does not step aside, we will ask Congress to investigate the matter and pursue legislative remedies.”
Brown’s fury comes after Justice Ginsburg dared to make a simple and factual observation about the state of the nation regarding same-sex marriage, one supported by a new poll out today that finds a whopping 60 percent support for the right of same-sex couples to marry.
In an interview published Thursday, Justice Ginsburg noted an “enormous” change in the public’s attitude toward same-sex marriage, adding it “would not take a large adjustment†for the nation to accept marriage equality.
“In recent years, people have said, ‘This is the way I am,’” Ginsburg told Bloomberg News. “And others looked around, and we discovered it’s our next-door neighbor — we’re very fond of them. Or it’s our child’s best friend, or even our child. I think that as more and more people came out and said that ‘this is who I am,’ the rest of us recognized that they are one of us.”
The 81-year old jurist echoed her remarks Thursday evening, at a forum held at George Washington University, with her very conservative colleague Antonin Scalia.
Justice Scalia also “foreshadowed,” to quote Brown, his ruling in the same-sex marriage case Thursday, as NCRM reported today.
“The issue of gay rights, on abortion, on many of the issues in which Ruth’s opinions and mine differ does not pertain to the substance,†Scalia told the audience. “It doesn’t pertain to whether gay people ought to have those rights or whether there ought to be a constitutional right or a right to an abortion,†he said. “That isn’t the issue. The issue is who decides.â€Â
“That’s all. I don’t have any public views on any of those things. The point is who decides? Should these decisions be made by the Supreme Court without any text in the Constitution or any history in the Constitution to support imposing on the whole country or is it a matter left to the people?†the jurist asked.
Scalia infamously noted his position on same-sex marriage in Lawrence v. Texas.
Americans should now fully expect NOM to “demand” Justice Scalia recuse himself, given his comments Thursday night, and in Lawrence.
