NOM, the National Organization For Marriage, is demanding the State of Florida break the law and observe its unconstitutional ban on same-sex marriage.
It’s easy to demand someone do something illegal when there is absolutely no consequence to you. Take the National Organization For Marriage, which late last year demanded Governor Sam Brownback ignore a federal court ruling and retain Kansas’ unconstitutional ban on same-sex marriage.
Zero cost to NOM, high cost to a public elected official.
Now, NOM is playing the exact same hand in Florida, perhaps the only hand it has left.
“Florida officials should not go along with this illegitimate decree and should demand that state and local officials continue to enforce the marriage amendment that was overwhelmingly adopted by Florida voters in 2008,” Brian Brown, NOM’s president, said in a statement released minutes ago.
Several judges have struck down Florida’s ban as unconstitutional, and the U.S. Supreme Court refused to extend a stay on a federal judge’s ruling past January 5, which is why hundreds of same-sex couples have married in the Sunshine State this week already.

“It is simply illegitimate for the opinion of a federal district judge to trump the decision of millions of Floridians and attempt to redefine marriage in violation of Federal law,” Brown continued. “Federal judges are acting as if the US Supreme Court has ordered same-sex marriage to be imposed, but in reality the Court has ruled that states have the right to define marriage. We demand that the US Supreme Court act immediately to review the pending marriage case before them and swiftly reaffirm that states have the right to define marriage as the union of one man and one woman.”
It’s unfortunate that a group which has as its chairman a constitutional law professor does not understand how the law actually works.
