Updated: Supreme Court Drops Stay, Kansas Marriages Can Begin

The U.S. Supreme Court, after granting a temporary stay on a federal ruling striking down Kansas’s ban on same-sex marriage has lifted the stay. 

The U.S. Supreme Court has just lifted the stay it placed on Monday on a ruling striking down Kansas’ same-sex marriage ban. Licenses can be given to same-sex couples immediately.

But an interesting note was included in this evening’s order: “Justices Scalia and Justice Thomas would grant the application for stay.”

Usually notices include no hints or extraneous information, often to the frustration of court watchers and legal experts. 

“Although the justices gave no reasons for their decisions, the decision by Scalia and Thomas to note their position that they would have granted a stay marked a change from recent stay requests out of Idaho and Alaska on marriage cases,” Chris Geidner at Buzzfeed notes. “In those matters, no justices announced opposition to the decision to allow same-sex couples to marry during any appeals.”

Regardless, let the celebrations begin!
