Breaking: Kansas Asks Supreme Court To Stay Same-Sex Marriage Ruling

In a curious turn of events, the State of Kansas is asking the Supreme Court to stay a ruling that struck down a ban on same-sex marriage.

The Attorney General for the State of Kansas has just filed a last-minute petition with the U.S. Supreme Court to place a stay on last week’s ruling that struck down its ban on same-sex marriage. The petition is 106 pages long.

What’s curious is that Kansas falls into the 10th Circuit, and the Supreme Court refused to hear any same-sex marriage cases, including one from Utah, which also falls into the 10th Circuit.

Chris Geidener at Buzzfeed reports “Kansas Attorney General Derek Schmidt, in a filing with Justice Sonia Sotomayor, has asked the Supreme Court to stop same-sex couples from being able to marry after 5 p.m. CT Tuesday.”

Geidner notes the Court “changed course in October after denying several states’ requests to hear appeals of challenges to their states’ bans. Since then, the court has allowed multiple rulings against bans on same-sex couples’ marriages to take effect, even during appeals.”

After last week’s decision from the 6th Circuit Court of Appeals upholding four states’ bans, however, lawyers on both sides of the issue will be watching the Supreme Court’s handling of the Kansas issue for some signals on whether the 6th Circuit decision has changed the dynamic on the issue with the justices.

The Supreme Court has been exceptionally generous in granting stays on same-sex marriage, perhaps out of an abundance of caution in not wanting to appear anything but impartial.
