Ruth Bader Ginsburg: ‘No Crying Need’ For Supreme Court To Take Up Same-Sex Marriage (Video)

Supreme Court Justice Ruth Bader Ginsburg in New York City last night explained why the nation’s top court hasn’t taken up the issue of same-sex marriage yet.

Back in July, Supreme Court Justice Ruth Bader Ginsburg made headlines when she said the nation’s highest court will definitely take a same-sex marriage case. In September, to the chagrin of those on either side of the issue, the progressive jurist retreated a bit, announcing she saw “no urgency” for the Supreme Court to take up a same-sex marriage case.

Last night, in an interview at the famous 92nd Street Y with NPR’s Nina Totenburg, Ginsburg again made news in much the same way the Supreme Court has recently in marriage cases — by not stating an opinion.

“As of now, all the Courts of Appeal agree, so there is no crying need for us to step in,” Ginsburg told the audience. 

“With three-quarters of the country,” Totenburg pressed, “now having gay marriage, is it really feasible to envision going back?”

“Going back?,” Ginsburg queried.

“Going back in states where it is allowed to not being allowed?,” Totenburg clarified.

“I can’t give an opinion on that,” Ginsburg responded.

Ginsburg had prefaced her comments by stating that “when there’s no disagreement among the Courts of Appeals we don’t step in. The major job of the court is to keep the law of the United States more or less uniform.”
