The Attorney General for the state of Utah has missed a filing deadline in his 10th Circuit Court of Appeals case. Reyes is fighting against recognizing the legal civil marriages of 1300 same-sex couples.
Sean Reyes might be too busy running for election to tend to the day-to-day requirements of the job he was appointed to. After a federal and state scandal investigation that took down the Attorney General of Utah, Governor Gary Herbert appointed Reyes to replace John Swallow. But Reyes, according to the Clerk of the 10th Circuit Court of Appeals, failed to meet a filing deadline today.
The case is Evans, et al v. State of Utah. Reyes is appealing a May 2014 ruling by Judge Dale A. Kimball that required Utah to recognize the almost 1300 same-sex couples who were legally married in that state before the U.S. Supreme Court placed on hold a December ruling striking down a same-ex marriage ban.
“You have failed to comply with the requirements of the Federal Rules of Appellate Procedure or Tenth Circuit Rules,” today’s letter to Reyes’ office reads (PDF). “Please correct the stated deficiencies within 10 days of the date of this notice.”
Reyes is spending a reported $2 million to fight the ruling.
The Salt Lake Tribune quotes “Missy Larsen,” whose role in the case is not identified, as claiming, “It won’t affect the case.”
