Not So Fast On That Ohio Same-Sex Marriage Ban Being Struck Down
Contrary to initial reports from the AP, a federal judge will not be striking down Ohio’s entire ban on same-sex marriages on April 14.
“The Court anticipates striking down as unconstitutional under all circumstances Ohio’s bans on recognizing legal same-sex marriages from other states,” according to the minutes of today’s case, published by Equality Case Files via Scribd (below).
“By announcing his intention ahead of his ruling, Black gives time for the state to prepare an appeal that can be filed as soon as he rules,” an updated AP article adds.
So, this is more like the Kentucky case, than the Michigan case.
Regardless, it’s a big step in the right direction.
