Watch: Pelosi Calls DOMA ‘Definitely Unconstitutional’ And Suggests GOP Knew It In 2005

Nancy Pelosi on Thursday told reporters she believes DOMA is “definitely unconstitutional,” and is suggesting the GOP knew this as far back as at least 2005.

“DOMA is definitely unconstitutional. But don’t take my word for it, the former Speaker of the House said:

“Around 2005 the Republicans, who were in the majority, passed legislation specifically related to DOMA, which had, as you know, passed some years before, in the ’90’s. But they came up with a specific bill relating to DOMA that stripped the courts of the right of judicial review. They said Marbury v. Madison was wrongly decided, that the courts do not have right of judicial review, and therefore they were stripping the courts of judicial review.

“Why would they do that if they thought they had a constitutional bill — specifically related to DOMA?”

Pelosi, now Minority Leader, adds she feels “pretty confident about what will happen” in the Supreme Court on the DOMA case the Court is hearing next week.

DOMA is the Defense of Marriage Act of 1996 that bans the federal government from recognizing same-sex marriages.
