Prop 8 Trial: Did NOM Push Copyright Issues (Again) With Video Feed?

NOM, the National Organization For Marriage, has been known to push the bounds of copyright, but this time it appears they really may have gone overboard. In their minds, apparently, it seems everything online is free for the taking. NOM, who supports Prop 8, also supported the efforts to keep the videos recorded by Judge Vaughn Walker out of the public’s hands. But today’s Prop 8 trial is available for viewing by the public, but only to cable subscribers in California, or online, at The California Channel’s website.

That isn’t stopping Maggie Gallagher’s NOM. Why not just hijack the video feed right from The California Channel? Just like their other actions, like lying about how many people attended their New York anti-gay hate rally. Back in July, we wrote,

NOM, the National Organization For Marriage, in a press release published Monday, falsely stated that “nearly 10,000 people were present” at their anti-​gay, anti-​same-​sex marriage, anti-​equality hate rally in midtown Manhattan, fallaciously titled, “Let The People Vote!” But police reports put the attendees at “more than 3,000 supporters,” (i.e., under 4,000) with news outlets mostly recording the attendees as “several thousand people.”

Three thousand was confirmed to The New Civil Rights Movement by New York City officials.

NOM’s website, Prop8Case.com, is showing the video live from the Prop 8 trial — the same video by comparison to the feed from The California Channel’s feed.

A question via a call to the folks at The California Channel was met with, “No, we do not offer the ability to embed the feed,” when asked if that feed specifically was embeddable.

So, how is it NOM is showing the feed on their own website? And why would they think it is OK to just grab it?

In the past, NOM has pushed copyright issues so far they’ve been met with at least one cease and desist letter. Instances of questionable copyright adherence: here, here, here, and here.

Why should NOM bother to follow the law? It’s so much easier to simply label the LGBT community as the ones who are behaving badly.
