Maggie Gallagher: DOMA Will Be Overturned

Yesterday, conservative pundits and strategists alike proclaimed the anti-gay marriage sentiment in America is “quite literally…dying” and it’s just “common sense” to embrace same-sex marriage. Now, the queen of the radical anti-gay marriage movement, Maggie Gallagher, has proclaimed that she believes DOMA, the Defense of Marriage Act of 1996 that bans the federal government from recognizing same-sex marriages, will be overturned by the Supreme Court.

“I think [Justice Anthony] Kennedy will overturn DOMA (perhaps joined by Roberts) and then uphold the right of states to refuse to accept gay marriage (i.e. uphold Prop 8),” she writes in response to a lazy David Blankenhorn blog post.

Wow.

Of course, Gallagher has qualified her thoughts — can’t give away the store, literally, since Gallagher has made her fortune battling same-sex marriage.

“The victories this November for gay marriage at the polls make that outcome more likely,” Gallagher notes. “Justice Kennedy will likely see it as not at all unlikely voters will overturn Prop 8 soon and see that as a much better outcome than constitutionalizing gay marriage.”

So, does this mean Gallagher thinks DOMA is unconstitutional? Jury is still out on that one, but it’s curious she’s not fighting it…
