Breaking: Obama DOJ Fights Federal Court’s “Don’t Ask, Don’t Tell” Decision

The Advocate is reporting (initially via Twitter) that the Obama Department of Justice has decided to “counter” a federal court’s ruling rendering “Don’t Ask, Don’t Tell” unconstitutional. The Log Cabin Republicans, who brought the case to the federal court six years ago, and won just weeks ago, asked for a permanent injunction on all “Don’t Ask, Don’t Tell” related investigations and discharges. The federal government at the last minute has called the injunction”untenable,” and is demanding the court limit its verdict to the plaintiffs named in the suit only.

Last night on The Rachel Maddow Show, Advocate reporter Kerry Eleveld said she thought it probable that the DOJ would attempt to limit the court’s decision in every way possible.

House Democrats this week sent a letter to President Obama urging him to not appeal the federal court’s decision and to let it stand, clearing the way for the military to end the investigations and discharges.

Evidently, the response was, “request denied.”
