  • Breaking: Congress Sending US Marshals To 'Hunt Down' Flint Emergency Manager Who Refused Subpoena

Subpoena Sent Overnight, Emergency Manager 'Declined' It

Tuesday night Darnell Earley was sent a subpoena to testify before Congress. He refused it, and through his attorney said it "borders on nonsensical." Earley was the emergency manager who oversaw the switch of Flint, Michigan's drinking water supply that resulted in a health crisis for the city, including irreversible lead poisoning of thousands of children.

House Oversight Committee Chairman Jason Chaffetz (R-UT) as this morning's hearing began observed Earley's refusal to obey the subpoena.

"We're calling on US Marshals to hunt [Earley] down and give him the subpoena to testify. He will be here," Chaffetz (photo) promised. "When you get invited to testify in front of the Oversight and Government Reform committee, you are going to show up."

U.S. Rep. Elijah Cummings spoke eloquently about the crisis:

The hearing now is live. You can watch above.

A lot is being made about the need to get rid of Snyder in Michigan. Meanwhile, this guy – the Emergency Manager – has his problems as well. But what this is about is the white right in Michigan attempting to make him the scapegoat. And it’s all a smokescreen in the end: the problems in Flint, Michigan reflect deeper systemic and structural problems that any changing of the guard is not going to do anything to address. What is needed is a massive investment, the kind that no politician, no candidate – is calling for at the present time. The money is not there. The only place the money is at is in the hands of the banks and the auto companies that have been systematically ripping Michigan off for the past generation.

I find it painfully ironic that a magazine which has appropriated a Black Rights movement name has posted an article gleefully celebrating the fact that the US Marshalls are being sent after a black man. Have you botherwdnto cover Snyder’s actions at all? The impacts of his antidemocratic, racist actions on the people – especially the Black People – of Flint? Yes Earley did something wrong and unjust. But look at you all. Look at yourselves and how white supremacist you are acting now. Or have you never read up on the connection between the US Marshalls and the Fugitive Act of 1850?

So they’ll send the US Marshalls after the flunky but won’t charge them with bringing in Snyder, the real criminal that poisoned an American city.

How odd that a scapegoat wants to escape the consequences of his actions. Did he not know what he was in for? He’s a college graduate, he isn’t a kid, what did he THINK was going to happen when they moved him to his THIRD placement after scandals in his first two – that he was going to get away with it forever?
